This Axoniq Privacy Policy (this "Privacy Policy") informs you about the collection and processing of your personal data by Axoniq B.V. and its subsidiaries, including [US ENTITY NAME], a Delaware corporation (hereinafter "Axoniq", "we", "us", or "our"), related to your use of the Axoniq website www.axoniq.io and associated websites and the use of our products and services. Axoniq understands that you value your privacy, and we take that seriously.
This Privacy Policy does not apply to websites or products or services that display or link to different privacy policies. This Privacy Policy also does not apply where Axoniq processes personal information of our customers on their behalf; our collection and processing of such personal information is governed by our agreements with those customers.
1. Why we process personal data
Axoniq processes your personal data for the following purposes and on the following legal bases:
Providing products and services, including sending invitations to seminars, events, and sharing communications such as newsletters: contract performance, or consent where required
Fulfilling our contractual obligations with your company: contract performance
Marketing personalisation and targeted advertising, including the use of IP addresses for geotargeting and ad personalisation: consent

Fraud prevention, IT security, and safeguarding our systems: legitimate interest
Use of artificial intelligence tools to support internal operations such as customer support, development, and marketing automation, where such tools process your personal data: legitimate interest or contract performance, as applicable
Compliance with legal obligations: legal obligation
Where we rely on consent as the legal basis, you have the right to withdraw your consent at any time. Withdrawal does not affect the lawfulness of processing carried out before withdrawal. You can withdraw consent by clicking "unsubscribe" in any marketing email or contacting privacy@axoniq.io.
Where we rely on legitimate interests, our use of your personal data is necessary to achieve those interests and does not override your rights.
2. How we collect information
When you visit our websites We collect personal data you provide yourself when you (i) register for any of our services or events; (ii) submit requests, suggestions, or other communications to us; or (iii) interact with our websites in any way that submits, releases, or displays your personal data to us.
When you use our products and services By using our products and services you may provide certain personal information — for example, when you register for an Axoniq subscription and create an account, when you consult with customer support, or if you send us an email or communicate with us in any way.
When you participate in training When you participate in a training, we ask for personal information so that we can communicate with you and so you can see your fellow students and vice versa. You can use a nickname if you want to, but we need a valid email address to provide the training. If you choose to log on through any social media account like Google or Facebook, your public profile photo is used for your account. After you create an account, you can change your account information. You can choose to change your name, email address, or photo, or choose not to publish any profile photo.
3. The personal information we collect
Personal information we collect may include:
Business contact information: such as your name, job title, organisation, phone number, email address, and country
Marketing information: such as your contact preferences (if you opt in)
Account log-in credentials: such as your email or username and password when you sign up for an account, and the unique User/Team ID assigned to you in our systems
Troubleshooting and support data: such as personal information you provide or we otherwise access in connection with support queries, including contact or authentication data, the content of your communications with Axoniq, and the product or service related to your inquiry
Job application data: such as your CV or résumé when you apply for a position via our website
Certain information is collected automatically from your browser or device, including:
Operating system and device information
Geolocation derived from IP address
IP address
Browser information, such as browser type, pages visited, and date and time of visit
Account and session activity: such as login timestamps, session duration, and session tokens associated with your account
Usage and interaction data: such as features accessed, navigation paths within our products, frequency and patterns of use, and actions taken during your session, where these are associated with your account or session
Error and diagnostic data: such as error logs and crash reports generated during product use, where these are associated with your account or session
API and product telemetry: such as the volume and frequency of API calls, query types, and performance metrics associated with your account or team
Developer environment data: such as the version of Axon Framework, Axon Server, or related SDKs you are using, and your deployment environment, where this information is linked to your account
Marketing attribution data: such as the referring URL, website or campaign source through which you arrived at our website, and any associated tracking parameters, where these are tied to your session or account. We are only able to associate this data with you as an individual if you have both submitted a form on our site and accepted cookies.
4. Anonymous Usage Data Collection
When using our software that contains usage data collection, the following information is collected unless you opt out:
Geolocation based on IP address (the IP address itself is deleted after geolocation has been determined)
Names and versions of all Axon modules used
Operating system and environment information
Anonymous usage statistics (e.g., features enabled)
Anonymised unique installation identifier (non-personal)
This data is used solely for:
Notification of vulnerabilities and recommended updates
Understanding general usage trends to prioritise features
Identifying production use of commercial extensions (if applicable) for licensing compliance
Accurate counting of corporate users based on supplied IP address lists (optional for users)
We do not store user content or data stored/processed by the software. All data is transmitted securely using TLS and stored in compliance with applicable data protection laws.

5. Artificial intelligence
Axoniq may use third-party AI-powered tools to support internal operations. Where these tools process your personal data, the relevant AI providers act as sub-processors under data processing agreements with Axoniq. We use your personal data with such tools only to the extent necessary for the purpose for which it was collected.
Our products include AI-powered features that may process your personal data. Where this is the case, we will inform you at the point of collection or within the relevant product feature.
Where AI processing involves automated decision-making that produces legal or similarly significant effects on you, this is disclosed in Section 6 below.
6. Automated decision-making
Axoniq uses automated processing to make decisions that may significantly affect you. Specifically, we process IP addresses alongside usage data to analyse how our tools are used. This automated analysis may inform decisions about your account status, fair use compliance, and access to our products or services.
7. Personal data obtained from third-party sources
We may occasionally receive your personal information from third-party sources including our affiliates and marketing and research partners. Users of our products or services may also provide your personal information when they identify you as a billing, support, or technical contact, or when inviting you to use our products or attend our events. If you integrate or link a third-party service with our websites or products, we may receive personal information about you from that third-party service based on the settings and permissions you have established with that service.
8. Third parties
Your personal information may be provided to the following categories of third parties:
Sub-processors, such as our hosting provider, email provider, AI tool providers, and platform providers
Payment providers that process your payments
Advertising and analytics platforms that receive IP address and usage data for marketing purposes
Providers that place cookies (see our cookie notice)
We may also share your personal data with our affiliates, agents, and contractors for purposes including facilitating sales, delivery or fulfilment of orders, verifying your identity, providing products and services you have purchased, and responding to your enquiries and in connection with supporting other legitimate business purposes of Axoniq.
In the event our business is sold, we may share your personal data with the buyer under our legitimate interest to ensure business continuity. If you object to this, the buyer may not be able to provide services to you.
Some third parties process personal data outside the EU/EEA. Axoniq will only transfer your personal data to countries that the European Commission has deemed adequate, or using contracts approved by the European Commission (Standard Contractual Clauses, 2021). These contracts ensure the same level of protection that would apply under the GDPR.
9. How long is personal data stored
Axoniq will not keep your personal data any longer than is necessary in light of the reason(s) for which it was collected. Your personal data will therefore be kept for the following periods:
For as long as you keep an active account on any Axoniq product or service
For as long as you wish to receive emails with Axoniq product and services information
For as long as we have a legitimate business interest such as maintaining appropriate business and financial records, protecting our legal interests, resolving disputes, or complying with legal or regulatory requirements
For 4 weeks in the case of job application data, or up to one year with your consent
If none of the above applies, for as long as necessary to fulfil the purpose of the processing
In some circumstances Axoniq may anonymise your personal data so that it can no longer be associated with you, and we may use this anonymised information indefinitely without notifying you. We use this anonymized information to improve the way we work and our services.

Our website does not currently respond to Do Not Track (DNT) browser signals.
11. Children's data
Our services are not directed to children. We do not knowingly process personal data of children under the age of 16 (EEA) or 13 (US) without verified parental consent, as required under applicable law.

EEA residents Depending on where you live and applicable data protection laws, you may have the right to: access your personal data; correct inaccurate or incomplete data; request erasure; restrict processing; receive your data in a portable format; object to processing based on legitimate interests or for direct marketing; and not be subject to solely automated decisions with significant effects.

You also have the right to lodge a complaint with the Autoriteit Persoonsgegevens (AP), the Dutch data protection authority, at www.autoriteitpersoonsgegevens.nl, or with the supervisory authority in your country of residence.
US residents — California (CCPA/CPRA) If you are a California resident, you may have the right to: know what personal information we collect and how it is used; delete your personal information; correct inaccurate personal information; opt out of the sale or sharing of your personal information; and not be discriminated against for exercising your rights.
Axoniq does not sell or share your personal information as defined under CCPA/CPRA.
Other US state residents If you are a resident of Virginia, Colorado, Connecticut, Texas, or another state with applicable privacy legislation, you may have similar rights to those described above.

Axoniq recognises that information privacy is an ongoing responsibility, and we may therefore change this Privacy Policy from time to time. This may for instance be necessary if the law changes, or if Axoniq changes its business in a way that affects the use of personal data.
